Breeding Contract

 

This STALLION BREEDING CONTRACT for the breeding season of 2009, is made and entered on the ______day of ___­___, 200__, by and between  M-G-M Quarter Horses, herein after referred to as “Breeder” and _______________________, herein after referred to as “Mare Owner”.  Mare owner, by signing this contract, is booking their mare __________________, Reg. No. _______________,to “THE VOO DOO DOCTOR”, AQHA Reg. # 3075995 for the fee of $400.00, with a live foal guarantee, subject to the following conditions.

 

1.            The breeding fee includes a non-refundable booking fee of $50.00, payable with this contract.  The balance is due at the time the mare is picked up.  Mare Owner may not remove mare from Breeder’s procession until all expenses are paid in full.

2.            Breeder agrees to provide suitable facilities for the care and feeding of the mare and/or foal while in his custody.  Mare Owner agrees to pay for feed and care at the rate of $10.00/dry mares and $12.00/wet mares.

3.            Mares must be halter broke and be reasonably safe for handling and breeding.  Mares that are not halter broke will not be accepted.  Mares should have rear shoes removed.

4.            Mares shall be healthy and sound for breeding.  Open mares are required to have a negative culture.  Wet mares and maiden mares, this is not a requirement.  A negative coggins is required on all mares. 

5.            Breeder agrees to diligently try to settle the mare.  If mare fails to become impregnated, Mare Owner will hold the Breeder blameless.   A substitute mare will be accepted if original mare proves to be barren.  

6.            This contract offers a “Live Foal Guarantee”.  This means a newborn foal which stands and nurses without assistance.  If the foal is born stillborn, you have the privilege of breeding the same mare for the 2010 season, subject to mare care.  HOWEVER, you must notify breeder within 10 days of the stillborn to receive this breeding.  If the mare should miscarry or abort, after she is confirmed in foal, the mare owner has the privilege to return her also, subject to mare care, for the 2010 breeding season. 

7.            A “Breeder’s Certificate” will be issued to Mare Owner, for the foal conceived by this mating.   Mare Owner will be totally responsible to the registration of the resulting foal to the appropriate breed registry and will pay for all fees associated with the same.

8.            A force-majeure binds and both parties agree to a waiver of subrogation and hold each other harmless.  Both parties agree that M-G-M Quarter Horses, the Breeder, is not liable for the death, sickness, and/or accident including consequential damages caused to the mare and/or foal unless such death, sickness, and/or accident was by willful negligence of the Breeder, and the Mare Owner is hereby not liable for the death, sickness, and/or accident including consequential damages caused to the stallion.

9.            If the stallion should die, be sold, or become unfit for service prior to the settling of the mare,  a refund of $350.00 of the breeding fee will be refunded, if it has been paid in full, thereby canceling this contract.

10.       This contract is non-transferable or non-assignable. 

11.       This contract is made under the jurisdiction of the State of Minnesota and will be interpreted and enforced under the laws of this state.  If any clause under this contract is proven to be against the law, then that clause will then be null and void.

12.       Any additional conditions of this service, shall be mutually agreed upon by both parties.  If none, please check (      ).

13.       This contract represents a binding contract between both parties.  No other agreements or promises, either verbal or written, were agreed upon prior to this contract.
